DoDelivery Terms & Conditions
DoDelivery LTD ("we", "our", or "us") and our staff are committed protecting the rights of everyone who makes use of our website dodelivery.co.uk, mobile applications and services (collectively, the "Sites" and/or "Services"). Please read the following terms & conditions that explain how we operate and keep everyone safe and avoid confusion.

2. General Terms of Use
When using our services, you agree to only use them for the purpose in which they are intended. We may refuse, limit and/or restrict access, to any individual, entity or address who breaks any of the terms laid out in this document.

When you place an order:

When placing an order on our Sites, you are offering to our network of delivery partners the oppertunity to deliver your items. We set a delivery fee based on the distance of your delivery address from the restaurant in which you are ordering based on prices we think are fair to both the customer and our partners.
After an order has been accepted by our delivery partners, you can verify confirmation on our Sites or by push notification and/or e-mail if you have Opted-In to receive such communication.
Our driver will then pick up your food and deliver it to your address in a timely manner. Please note our delivery times quoted to the Customer are approximate timeframes only and for the safety & consideration of our drivers, time shall not be considered to be of the essense for any order.
We do endeavour to deliver your food as quickly as possible however.
If any of the items are not available for delivery at the time of the order, the customer will be offered either an exchange of that item for another item of equal or lower value, or a refund for that particular item.

You are not permitted to use this website other than for the following, private, non-commercial purposes: (i) viewing this website; (ii) making orders; (iii) reviewing/changing orders; (iv) checking order information; (v) leaving reviews; (vi) transferring to other websites through links provided on the Site; and (vii) making use of other facilities that may be provided on the Site. The use of automated systems or software to extract or input data from or to the Site for commercial purposes, (‘screen scraping’ or ‘botting’) is prohibited unless the third party has directly concluded a written licence agreement with DoDelivery Ltd in which permits it access/process DoDelivery’s price, delivery and/or other information or performs any other action without permission.

3. Allergies
DoDelivery Ltd and it's Drivers do not (but not limited to) manufacture, create, invent, cook, prepare, or construct any food items. Our Drivers simply facilitate the delivery of products from the Restaurant in which the Customer is purchasing the food from to the Customer's designated delivery address. If you have any questions about food allergies or intolerances and/or any of the people dining with you have any of these concerns. Please contact the restaurant from which you are ordering. Their contact details can be found in their Menu Info section our our Sites. Any questions relating to Delivery should be handled through the DoDelivery support channels.

4. Delivery Process
A delivery is only to be considered confirmed and in progress when our Site indicates this as part of the order process.

The following occurs when you place an order on our site:
Please Note: In some circumstances where we do not have an agreement in place with a certain restaurant, shop or vendor, our driver/rider will act as the Delivery Partner on your behalf.

Our drivers are all committed and bound by a strict terms & conditions and privacy policy to ensure your data is kept secure and private. We expect a high level of professionalism, respectability and cleanliness from all of our partners.

If you submit comments or feedback to us regarding our products / services and/or partners, we may use your name and any information you have submitted to us in the form. This information may be visible to the public (if you choose to submit it).

5. Exchanges / Refunds
Where a particular item is not available at the Restaurant you have ordered from due to being out of stock or for another reason, we will offer you the option within our Site to continue the order without the item(s) and refund the difference.

Where this happens, we will start a timer of 2 minutes for you to cancel your order (where we will refund the whole amount), or if you choose (or the timer runs out WITHOUT response) we will continue the delivery without the highlighted items.

As DoDelivery and it's partners are only a facilitators of delivery services, we cannot under any circumstances after delivery has been completed, refund or exchange any item or order in any capacity. This is due to the custom nature of the products in which are being delivered and Health & Safety concerns. This of course does not affect your right to seek a refund or other means of settlement with the Restaurant as they are ultimately the Company which is supplying your goods. DoDelivery will provide you with receipts, order numbers and any other information relating to the payment and delivery of your order (that we possess) upon request by either the Customer or the Restaurant.

Your driver will keep your food in an insulated delivery bag and try to maintain the temperature of your order to the best of their abilities. However any disputes regarding food temperatures ultimately should be taken up with the restaurant you are ordering from. DoDelivery and it's riders are ONLY facilitators of delivery and do not control the temperature at which the food is cooked or how far your delivery address is from the restaurant. We do however impose a delivery limit of 10 miles to try and mitigate issues with food temperatures.

6. Gift Cards / Discount Codes
Where you have used a valid, in-date (if applicable) gift card / discount code. We will deduct the total value of the code from the balance on our Site within our checkout process.

Only one discount code may be used per order at a time.

By purchasing Gift Cards from DoDelivery you agree to be bound by the following terms:

This DoDelivery Cash Purchase Agreement ("Agreement") is between and among DoDelivery Ltd. (“DoDelivery”), the purchaser and/or redeemer of DoDelivery Cash (“you”).

"DoDelivery Cash", for the purposes of this Agreement, means: (i) a load amount value in the form of a DoDelivery Gift Card (“Gift Card”), which is issued directly to you by DoDelivery Ltd, and (ii) in some but not necessarily all cases, supplemental or “bonus” value provided to you as a promotion or for appeasement purposes, by DoDelivery. For the purposes of clarity and avoidance of doubt, solely as used in this Agreement, DoDelivery Cash does not mean any amount earned by you as a result of your providing services to riders, eaters and/or restaurants.

You must have an active and valid DoDelivery account to purchase and to redeem DoDelivery Cash, and your use of DoDelivery Cash is subject to the DoDelivery Terms of Use. DoDelivery may from time to time request information from you to confirm your identity before it will allow use of DoDelivery Cash or remitting any amounts to you in order to comply with relevant anti-money laundering laws. DoDelivery may delay your access to the DoDelivery Cash services and remittance of funds until you comply with this information request. DoDelivery Cash may only be redeemed via the DoDelivery app and used within the United Kingdom in locations where DoDelivery services, as applicable, are available. DoDelivery reserves the right to modify the scope of services for which DoDelivery Cash can be redeemed. DoDelivery Cash may not be redeemed outside of the United Kingdom, nor in United Kingdom cities where DoDelivery, is not available. No portion of DoDelivery Cash is transferrable to another party.

The Gift Card cannot be reloaded with additional funds after purchase. No fees apply to the Gift Card, and the Gift Card’s load value never expires.

No portion of DoDelivery Cash is refundable, returnable, or redeemable for cash except where required by law. DoDelivery is not responsible for unauthorized use of DoDelivery Cash. DoDelivery reserves the right to suspend or void DoDelivery Cash if DoDelivery suspects that the DoDelivery Cash was obtained or used fraudulently, unlawfully, or otherwise in violation of this Agreement.

DoDelivery may modify any of this Agreement’s terms and conditions at any time, with or without notice to you, subject to applicable law. The most current Agreement shall be available at dodelivery.co.uk/terms.php, and will supersede all previous versions of the Agreement. The most current Agreement shall be effective upon DoDelivery’s posting of such modified Agreement. Your use of any portion of DoDelivery Cash after such posting constitutes your acceptance of the modified Agreement. If any term of this Agreement is deemed to be invalid, void or for any reason unenforceable, such term shall be deemed severable and will not affect the validity and enforceability of any remaining terms of this Agreement. 7. Marketing
Where you have given permission to do so and we have an interest in doing so we may use your information to send you marketing materials about our products / services, by email, post or phone.

You can control your marketing preferences in the Privacy section of your profile on our Sites.

8. Automated Decision Making
We perform fraud checks on all of our users. Where we detect fraud or suspicious activity we may block you from using our Sites. We perform these checks on all of our users because this is necessary for us to fulfill our contractual obligations to our partners and provide contractual services to our customers, by ensuring that all products and services we provide are duly paid for. We also have an obligation to protect individuals against fraud of their card details.

Due to the amount of transactions we deal with, we use automated systems to deal with third party fraud detection. This service analyses your order data in order to make automated decisions as to weather or not we will accept your order. We find this more efficient, fairer and quicker for the customer as with a human processor and the volume of transactions we deal with on a daily basis, without this it would simply not be possible. If we detect fraudulent or suspicious activity we may block you from using our services, and will contact the legal authorities and prosecute to the maximum extent allowed by law.

You have the right to contest any fraud decision made about you and to be given more information about why any such decision was made by contacting us as set out in section 1 above.

9. Zero-Tolerance Policy
Please note that we operate a zero-tolerance policy in regards to hate speech, racism, violence, verbal abuse or any other kind of intimidating behaviour.
